Due to the proximity of residential units, and in order to achieve a fair balance between commercial need and the amenity of neighbours, conditions were attached to the original planning permission for a restaurant, bar, function rooms and conference rooms (Reference: ST/0692/08/FUL) which restricted the opening of the bar/restaurant to 23.00 hours and restricted the use of the front entrance door onto Dean Road to 23.00 hours. Further planning permissions varied the conditions to extend the use of the front entrance door onto Dean Road from 23.00 hours to 23.30 hours (Reference: ST/1840/10/VC), and then from 23.30 hours to 00.00 hours (Reference: ST/0247/15/VC). It is considered that there has been no significant change in circumstances since the granting of permission and that the restrictions imposed previously are still necessary in order to protect the residential amenity of neighbours. It is considered that the proposal to allow the bar/restaurant to be open for business until 1am on Fridays, Saturdays and Bank Holidays and to allow the use of the front entrance door onto Dean Road until 1am on Fridays, Saturdays and Bank Holidays would result in neighbouring residents being subjected to increased and unacceptable levels of noise disturbance from the bar/restaurant and by way of comings and goings of patrons during unsociable hours. As such, the proposal would be contrary to Core Strategy Policy EA5 (Environmental Protection) and Development Management Policy DM1 (Management of Development) of the South Tyneside Local Development Framework.
